Egypt presidential election body weighs complaints

CAIRO (Reuters) - Egypt's election committee on Sunday considered complaints about a presidential poll that has left voters with what many see as a painful run-off choice between an Islamist apparatchik and a throwback to Hosni Mubarak's era.

Both contenders are seeking to lay claim to the mantle of the "revolution" that toppled Mubarak 15 months ago, and to appeal to the many Egyptians who picked more centrist figures in last week's first round.

Hatem Bagato, the secretary-general of the electoral committee, said it was investigating complaints about the voting filed by four candidates - second-placed Ahmed Shafiq, who was Mubarak's last prime minister, leftist Hamdeen Sabahy, moderate Islamist Abdel Moneim Abol Fotouh and former Arab League chief Amr Moussa.

"The (election) results will be announced on Monday or Tuesday at the latest," Bagato told Reuters by telephone.

Figures cited by state media and party campaigns put Mohamed Mursi, a colorless Brotherhood insider, in a run-off with Shafiq, a bluff ex-air force chief who has sworn to restore security.

But Sabahy, who came a close third, challenged his placing. "We have information that conscripts voted illegally," he told a raucous crowd of supporters in Cairo late on Saturday.

Abol Fotouh wrote on his Facebook page on Sunday: "I request that the Supreme Presidential Elections Committee does not conduct the run-off until the Constitutional Court rules on the political ban law," referring to a ruling on a law banning Mubarak's top aides from running for the presidency.

Former U.S. President Jimmy Carter said he was broadly confident about the election process although Carter Center monitors highlighted several irregularities, notably lack of access in the final aggregation of national results.

The polarized outcome has even led to suggestions from a range of liberal and other politicians - swiftly rejected by the Brotherhood - that Mursi should withdraw to allow Sabahy to go through to the second round.

"This is unconstitutional," Essam el-Erian, a leader of the Brotherhood's Freedom and Justice Party (FJP), said, adding that if Mursi quit at this stage, Shafiq would win by default.

An FJP source said the Brotherhood believed vote-rigging had helped Shafiq qualify for the second round, but that it had decided not to complain for fear the election might be invalidated and that a re-run might endanger Mursi's chances.

The source, who asked not to be named, said he believed this was a mistake, because it meant the Brotherhood was failing to show solidarity with other parties and that it would have no credibility if it appealed later against the result of the run-off.

INVESTORS SPOOKED

The divisive turn taken by the presidential election depressed Egyptian share prices on Sunday, the first day of trading since two days of voting ended on Thursday.

"Some investors are afraid that because we now have the two extreme elements confronting one another, the coming period will not be calm," said Osama Mourad, CEO at Arab Finance Brokerage.

The benchmark index dropped 3.5 percent by the close, its biggest single-day fall for nine weeks.

The Brotherhood, which already dominates both houses of parliament after earlier elections, wants to draw rival parties into a broad front to beat Shafiq in the June 16 and 17 run-off.

"We have to organize the movement on the street with the grass roots to support the revolution because the old regime is coming back with Shafiq," said a Mursi spokesman Yasser Ali.

"We are open-minded and open-hearted with all political groups, especially the revolutionary groups, to organize and form a coalition government soon after Mursi becomes president."

Ali said Mursi, 60, might meet Abol Fotouh, a former Brotherhood member who came fourth in the first round, and other leaders, possibly including Sabahy, later in the day.

Shafiq, 70, is also reaching out to voters, including the young activists who despise him as a figure from the past.

"Your revolution was stolen," he said at a news conference on Saturday. "I pledge to return its fruits to your hands."

The presidential election is supposed to close an army-led transition punctuated by violence and political disputes since a popular uprising overthrew Mubarak in February last year.

The turbulence has aggravated economic problems that will loom large for any president who takes over from military rulers who took charge when Mubarak fell and are expected to retain a strong role for years to come.

A Brotherhood victory in the presidential election could prolong a struggle with the military over the drafting of a new constitution, already mired in a political wrangle.

But a Mursi triumph is no foregone conclusion.

Many voters may stay away from the second round, seeing both candidates as unpalatable.

And many Christians, who make up about 10 percent of Egypt's 82 million people, are likely to swing behind Shafiq, viewing him as a bulwark against rising Islamist influence.

"The Brotherhood has not given us any assurances or promises to make us not fear for our freedoms and faith under their rule," said a Coptic church official, who asked not to be named.

Asked about Christian fears, Mursi told a television interviewer on Saturday night that "Egypt belongs to all," asking: "Who killed them in protests? Who prevented them from building churches? The old (Mubarak) regime, not us."

Spain Minister: Bankia needs to bolster defenses

(AP) ? Bankia, the nationalized Spanish bank which had to reassure savers last week to fend off a reported run on its deposits, needs to strengthen its capital defenses by as much as ?7.5 billion ($9.56 billion), the country's economy minister said Monday.

The minister, Luis de Guindos, said Bankia needed to find around ?7 billion to ?7.5 billion to meet the Spanish government's new provisioning requirements designed to strengthen the country's banking industry against further economic shocks. If Bankia cannot raise the money itself, it will have to tap the state bank rescue fund, FROB. This could increase the government's bill for keeping Bankia afloat to ?12 billion.

Like other banks, Bankia has until June 11 to tell the government how it plans to come up with the money for stronger defenses.

De Guindos Monday also dismissed comments from the new French President Francois Hollande that Spain's banks might need money from European recapitalization funds to stay in business. The minister said Hollande "probably knows the French banking sector better than the Spanish one."

This process will take longer and the results of the studies will be known "in the next few months."

De Guindos was speaking following the announcement by the Spanish government late Friday that Spain's 2011 budget deficit was higher than expected ? the second upward revision in recent months. The minister said the increase in the 2011 deficit figure from 8.5 percent of national income to 8.9 percent was due to overspending by four regions, which had not been "totally transparent" in providing figures initially.

The minister also said the Spanish economy, which has contracted by 0.3 percent in each of the past two quarters, will shrink by about the same amount in the second quarter of 2012. The forecast is for it to decline 1.7 percent for the year.

(AP) ? Three men accused of making Molotov cocktails had been planning to attack President Barack Obama's campaign headquarters, Mayor Rahm Emanuel's home and other targets during this weekend's NATO summit, prosecutors said Saturday.

The three were arrested Wednesday when police raided an apartment on the city's South Side ahead of the two-day meeting.

Defense attorneys alleged that the arrests were an effort to scare the thousands of people expected to protest at the gathering of world leaders. They told a judge that undercover police were the ones who brought the Molotov cocktails.

"This is just propaganda to create a climate of fear," defense attorney Michael Duetsch said.

Later, outside the courtroom, Duetsch said two undercover police officers or informants who called themselves "Mo" and "Gloves" were also arrested during the Wednesday raid, and defense attorneys said they later lost track of the two.

"We believe this is all a setup and entrapment to the highest degree," Duetsch said.

The trio was charged with providing material support for terrorism, conspiracy to commit terrorism and possession of explosives.

The suspects were each being held on $1.5 million bond. They apparently came to Chicago late last month to take part in May Day protests. Six others arrested Wednesday in the raid were released Friday without being charged.

Chicago police Lt. Kenneth Stoppa declined to elaborate on the case beyond confirming the charges against the three who were still in custody.

Police identified the suspects as Brian Church, 20, of Ft. Lauderdale, Fla.; Jared Chase, 24, of Keene, N.H.; and Brent Vincent Betterly, 24. A police spokesman gave Betterly's hometown as Oakland Park, Mass., but no such town exists. There is an Oakland Park, Fla., that is near Fort Lauderdale.

Activist Bill Vassilakis, who said he let the men stay in his apartment, described Betterly as an industrial electrician who had volunteered to help with wiring at The Plant, a former meatpacking facility that has been turned into a food incubator with the city's backing.

Vassilakis said he thought the charges were unwarranted.

"All I can say about that is, if you knew Brent, you would find that to be the most ridiculous thing you've ever heard. He was the most stand-up guy that was staying with me. He and the other guys had done nothing but volunteer their time and energy," he said.

Betterly appears to have a history of minor run-ins with law enforcement.

He was cited for disorderly intoxication in February in Miami-Dade County, Fla., earlier this year , but the case has been dismissed, according to online court records.

Authorities in Oakland Park, Fla., said Betterly and two other young men walked into a public high school last fall after a night of tequila drinking and took a swim in the pool, according to a report in the South Florida Sun-Sentinel.

They stole fire extinguishers from three school buses, discharged one and smashed a cafeteria window with another. The vandalism caused about $2,000 in damage. Betterly was charged with burglary, theft and criminal mischief, the newspaper said.

Chase grew up in Keene, N.H., and moved to Boston a few years ago before becoming active in the Occupy movement, said his aunt, Barbara Chase of Westmoreland, N.H.

She said she was stunned to learn of the charges against her nephew.

"That surprised me because he's not that dumb, at least I wouldn't have thought so anyway," said Barbara Chase, a factory worker. "He always seemed harmless, but who knows? Outside influences sometimes can sway people to do things that they normally wouldn't do."

Jared Chase's father, Steve Chase, died about five weeks ago after a long struggle with a disease that left him disabled, Barbara Chase said. The family had been waiting for him to come home before having a funeral.

The arrests came as authorities tightened security throughout the city in preparation for the summit, where delegations from about 60 countries will discuss the war in Afghanistan and European missile defense.

Downtown streets were largely empty Saturday, though that is not unusual for a weekend. Security guards stood watch outside many downtown buildings and in some places almost outnumbered pedestrians.

By mid-afternoon, hundreds of protesters marched from a park to the mayor's house, stopping traffic along the way. Police with bicycles stood guard in front of the Northwest Side home, wearing helmets with face shields.

Some of the protesters sat for a time in the middle of the street. Others climbed trees. One woman carried a sign calling Emanuel a bully for closing mental health clinics and libraries in poor neighborhoods. Others chanted that health care should be a human right.

"We are exercising our power to go and tell him what we want," said N'Dana Carter, who was wearing a hospital gown for the demonstration. "He will hear our message."

A city representative said Emanuel respects the demonstrators' First Amendment right to expression.

The bigger show will be on Sunday, the start of the summit, when thousands of protesters are expected to march 2? miles from a band shell on Lake Michigan to the McCormick Place convention center, where delegates will be meeting.

Dewey to consider bankruptcy filing: source - Financial News

NEW YORK (Reuters) - Ailing law firm Dewey & LeBoeuf is considering a bankruptcy filing as new debtholders take a more aggressive track, shifting away from earlier attempts at an out-of-court liquidation, a person familiar with the matter said on Friday.

The majority of Dewey's partners have quit as a result of concerns about compensation, and $225 million in bank loans and bond debt.

Buyers of distressed debt who have acquired Dewey's debt at a discount on the secondary market are more open to seeing the firm wound down in bankruptcy court rather than out of it, said the person, who requested anonymity because the information was not public.

With the emergence of new creditors, Dewey on Tuesday replaced restructuring adviser Development Specialists Inc. (DSI) with competitor Zolfo Cooper. Joff Mitchell, a senior managing director at Zolfo, is now Dewey's chief restructuring officer, two people familiar with the situation said.

Bill Brandt, chief executive of DSI, confirmed that his firm's involvement in the matter was coming to an end.

"Our firm is transitioning out," Brandt said. "We've been replaced by Zolfo at the insistence of the debt holders. It now becomes a creditor-driven case."

A bankruptcy filing is not certain, and the timing of any potential filing remains unclear. The firm has been consulting with restructuring lawyers since April at the latest, and has retained bankruptcy attorney Albert Togut of law firm Togut Segal & Segal.

Neither Stephen Horvath III, Dewey's executive partner, nor Janis Meyer, its general counsel, responded to requests for comment. Mitchell and a spokesperson for Zolfo also did not respond to requests for comment.

Togut did not respond to a request for comment on Friday.

A spokesman for the firm's primary bank lender, JPMorgan Chase & Co, declined to comment late on Friday.

Once one of the largest law firms in the United States, Dewey & LeBoeuf has lost all but a handful of the 300 partners with which it opened 2012. It has laid off 433 of 533 employees in New York, according to the New York State Labor Department.

Dewey's debtholders have been selling their stakes during the firm's downfall. As of May 3, bankruptcy analyst Kevin Starke of CRT Capital Group said Dewey's $150 million in notes privately placed following a 2010 bond offering were trading at between 45 cents and 55 cents on the dollar on the secondary market.

The shift toward a possible bankruptcy filing would be a major change in direction. As recently as March 12, Martin Bienenstock, formerly a top bankruptcy partner at Dewey and an outgoing member of the firm's office of the chairman, told the Wall Street Journal that the firm had "no plan to file a Chapter 11 bankruptcy."

"We've had a completely non-adversarial relationship with our lenders, and right now the cash we're using is the lender's collateral," he said at the time.

Bienenstock did not respond to a request for comment late on Friday. He was one of four members of Dewey's top management team, the office of the chairman, to decamp to other firms in recent days, joining Proskauer Rose. The last member of that office, Washington, D.C., lobbyist L. Charles Landgraf, said he had joined Arnold & Porter on Wednesday.

Lawsuits are mounting against Dewey. The U.S. Pension Benefit Guaranty Corporation sued the firm Monday in Manhattan federal district court in order to take control of three of the firm's pension plans, which the agency said were underfunded by $80 million.

Bankruptcies are often driven by creditors. On Wednesday, Annette Jarvis of Dorsey & Whitney, a bankruptcy lawyer who represents a group of 51 retired pension partners at Dewey predecessor LeBoeuf Lamb Greene & MacRae, said that in her view the firm "has to be put into a bankruptcy."

Jarvis did not respond to a request for comment on Friday.

Facebook IPO volume = headaches for Nasdaq

CNBC's "Street Signs" crew explains Nasdaq's trading glitches today amid Facebook's IPO and also Mark Zuckerberg's statement.

The weight of Facebook's (FB) popularity seemed to bog down the Nasdaq in the initial minutes of the social network's debut trading.

CNBC reported that the exchange was investigating reports of a lag in trade execution notifications shortly after the stock made its delayed debut at around 11:30 a.m, ET. Traders took to Twitter to grouse about the bumpy start. The Wall Street Journal said suspected queue problems left traders unable to change or cancel premarket orders placed as early as 7:30 a.m., and some traders found themselves waiting up to an hour and a half after the 11:30 kickoff to get confirmation of their trades.

Sam Hamadeh, CEO of private company research firm PrivCo, said sheer volume swamped Nasdaq once trading began. According to CNBC, as much as 25 percent of Facebook shares were allocated for the retail market, an abnormally high figure.

"There were 310 million [shares traded] in 90 minutes," Hamadeh said. "It's just massive volume." By comparison, a typical Nasdaq heavy mover like Cisco only saw one-tenth the amount of trading volume in roughly the same time period, he said.

This glitch is reminiscent of the breakdown suffered by BATS Global Markets when the electronic exchange debuted its own stock back in March. The company described the incident as a "systems issue affecting trades in securities in symbol range A through BF." In addition to BATS own stock, trades of Apple were also affected. The exchange's technical difficulties were enough of a distraction that the company quickly announced it was withdrawing its IPO ? a nearly-unprecedented response.?

Richard Repetto, principal of Sandler O'Neill, said Nasdaq is unlikely to suffer the same fallout BATS experienced. In an interview with CNBC, Repetto said the glitch wasn't of the same magnitude and didn't spill over into the trading of other stocks.?

A Nasdaq OMX (NDAQ) spokesperson did not immediately respond to a request for comment.?

Facebook bears may have been taking out their skepticism on Zynga (ZNGA). Trading in shares in the online game developer, whose business is inextricably linked with that of Facebook, had to be halted twice after rapid, precipitous slides sent the stock price tumbling down near $7.

To the Editors:

I admire Ronald Dworkin greatly, and I certainly defer to him on most legal matters, so it is with some reluctance that I take issue with his essay ?Why the Mandate Is Constitutional: The Real Argument? [NYR, May 10]. I have several objections, most of which concern not the legal matters, but his more general comments about the virtues of the Affordable Care Act (ACA).

Dworkin exaggerates the benefits of the ACA. For example, he writes that ?the act provides, among other benefits, health care insurance for the 16 percent of citizens who now lack it?.? It does not. Of the 50 million uninsured Americans at the time the ACA was enacted, the law was designed to cover just 32 million, leaving 18 million still uninsured. Half of the 32 million would gain coverage simply by virtue of expanding Medicaid eligibility?something that did not require the whole apparatus of the ACA. So the mandate that requires uninsured people to buy private insurance, which is at the heart of the Supreme Court challenge, would cover only 16 million people, a mere 5 percent of the population.

He also refers to the Massachusetts mandate as the core of ?that state?s apparently successful health care program, on which the national act was partly based.? But the Massachusetts plan, which has been in effect for five years, is rapidly becoming unsustainable. Health care now consumes 43 percent of the state budget, a percentage that has been growing, while expenditures on every other budgetary category?including education, human services, infrastructure, law, and public safety?have been shrinking. Although Massachusetts began with advantages the rest of the country doesn?t have?an already high rate of insurance and a large ?free care pool,? provided by hospital and insurance fees, that was tapped to subsidize the new plan?it is still unable to afford it.

The legislature is now trying to contain costs by devising new payment methods for providers, while insurers are raising premiums, deductibles, and copayments. The problem in Massachusetts is that there was no way to control the costs of an inherently inflationary reform, just as there isn?t in the ACA. Massachusetts should be seen not as an inspiration, but as a warning.

Dworkin argues that there are national precedents for the ACA mandate to purchase health insurance. But is that true? The mandate is not like the requirement to pay for Medicare and Social Security through payroll taxes. Instead, it requires people to buy a commercial product from investor-owned companies at whatever price the companies choose to charge. In short, people are required to contribute to the profits and corporate salaries and marketing costs of companies like WellPoint and UnitedHealthCare. I don?t believe there is any precedent for that.

My objection to the mandate is not that it requires people to purchase insurance, but that it specifies they buy it from investor-owned companies, whose practices have done much to make our health care system the ?unjust and expensive shambles? Dworkin accurately describes it as being. No one should be required to enter this treacherous market; it is not the same as paying for publicly administered services, like Medicare or police and fire protection.

Dworkin dismisses concerns that if Congress can make us buy private health insurance, then it can make us buy any other commercial product, arguing that public opinion would prevent Congress from unreasonably extending its power in that way (?politics supplies the appropriate check?). That?s a mighty thin reed to hold on to, given the recent record of Congress and its capture by corporate interests. I would feel better if we didn?t provide the precedent.

He is also too sanguine about the ability of regulations to stop the worst abuses of the private insurance industry, such as denying coverage for people with pre-existing conditions. The fact remains that these companies will profit by avoiding high-risk patients if they possibly can, and they will probably find ways to do so. The ACA does some of that work for them, by allowing them to charge up to three times as much for older patients as for younger ones, age being a good proxy for a higher risk of chronic illness. A few years ago, in a private discussion with a senior executive of America?s Health Insurance Plans, the industry?s trade association, I was told that if the regulations did squeeze the profits of the insurers, they would simply raise the premiums. There is nothing in the ACA to prevent that.

In a press conference on July 22, 2009, while the ACA was being crafted, President Obama said, ?Now, the truth is that unless you have what?s called a single-payer system in which everybody is automatically covered, then you?re probably not going to reach every single individual.? He was right. Moreover, a single-payer system is the only way to do so while containing costs. Polls have shown that most Americans favor it, and a Massachusetts survey showed that physicians there prefer it to the state?s current system. I?ve advocated extending Medicare to everyone by dropping the qualifying age one decade at a time, and delivering it in a nonprofit system, something I believe the public would enthusiastically accept.

Dworkin, like many others, dismisses a single-payer system as unrealistic, saying it would be ?politically impossible in the United States now, or in the foreseeable future.? But the fact that Congress lags behind public opinion is surely partly due to liberals accepting the premise that a single-payer system is off the table, while what is truly unrealistic is imagining that we can provide universal and affordable health care in a market-based system.

Marcia Angell is an important expert on American health care. She has contributed excellent articles on that subject to The New York Review and I have learned much from her. My article was about the constitutionality of the Affordable Care Act, not about its merits, but I made plain my opinion that the act would make a considerable improvement in American health care and she disagrees. She apparently hopes that the Supreme Court will strike the act down and save the country from a precedent that allows Congress to force people to buy products from private companies. She thinks it reasonable to suppose that a new Congress would then pass a much more radical and effective scheme: a ?single-payer? national health service funded entirely by government out of federal taxes.

I agree that such a scheme would be better than what the act provides, but I also agree with the writer who said, in these pages, that ?such a system does not have the remotest chance of being legislated by our national government anytime soon.?* Liberal congressmen tried and failed to secure a ?public option? supplement to the act that would have allowed the government to offer insurance in competition with private insurers. A single-payer system would be much more radical than a public option: even Senator Edward Kennedy, who was among the most powerful advocates of a single-payer system, long ago abandoned all hope of achieving it, according to Jeff Madrick, a former economic adviser to the senator.

In any case, it seems a mistake to dismiss the act because something better might conceivably take its place in the future. Reducing the age of eligibility for Medicare to fifty-five, while requiring payment of a premium, was in fact considered and rejected. Perhaps a similar arrangement, or the extension of standard Medicare, remains possible. If so, such changes should be pursued. But I believe it wiser for influential experts like Angell to continue to work toward improvements of this kind, taking the act as a base, than to revert to a status quo in which so many millions of Americans couldn?t afford insurance or were denied it even though they could. Scorched earth is never good policy.

Angell offers more detailed criticism of my article. She says that I exaggerated the benefits of the act in saying that it provides health insurance for the 16 percent of Americans who are now uninsured. My statement was more simplification than exaggeration, however. The Congressional Budget Office reports that without the act, or something like it, the United States would have 54 million uninsured by 2019; with the act the CBO predicts 23 million. Of the latter, a third will be illegal aliens, who will nevertheless continue to be entitled to emergency care. Another third will be people eligible for Medicaid but who fail to enroll. The last third will be those, mostly younger and single, who choose to pay the penalty tax?a maximum rising to 2.5 percent of income or $695, whichever is greater, by 2016?instead of buying insurance, or those who for a variety of reasons are not required to pay a penalty at all if they remain uninsured. The number of Americans whom the act will leave involuntarily uninsured seems marginal.

The Massachusetts plan has indeed been successful in significantly expanding insurance coverage. I agree that it has not controlled health care costs, which continue to rise steeply and unsustainably, both in that state and nationally. However, Massachusetts legislators have now introduced a bill that would cap the rate of increase of overall health care costs in the state at the rate of increase in the state?s gross domestic product, or, after 2016, at half a percentage point below that rate, and it would grant regulators a variety of enforcement powers. That bill might serve as a model for other states as well.

Still, it remains unclear how far health care costs can be curtailed. Greed and bad politics are no doubt an important part of the problem, but by no means all of it. Populations are growing steadily older and medical technology steadily more sophisticated and expensive. Even single-payer systems have proved unable to reverse the trend. Costs in the most famous of these?the British NHS?rose from ?38 billion a year in 1997 to ?102 billion today, and are estimated to reach ?230 billion in 2030. Cost-cutting reform of the NHS remains a perennial challenge in British politics.

Radical imagination?and a political will that is hard now to anticipate?may be required effectively to confront the problem. But it would be a mistake to see the obvious justice of the act?s expanded insurance coverage as a step in the wrong direction. The act does contain provisions aimed at cost reduction (these are summarized at www.kaiseredu.org/issue-modules/us-health-care-costs/background-brief.aspx) though it is not clear that these will be particularly effective. I believe that more hope lies in the prospect that once voters realize?as someday they must?how much most of them have benefited from the act?s greatly improved coverage, it will become politically possible to add a public option provision that would indeed significantly reduce overall insurance costs.

Angell writes that the act forces people to buy insurance from private insurance companies ?at whatever price the companies choose to charge.? It does not. It imposes a 40 percent excise tax on expensive ?Cadillac? policies. It requires insurers to spend 80 percent of the premiums they receive?85 percent for large employer plans?on medical care (the average now is 70 percent) and to refund premiums if they do not. It imposes only a relatively low tax penalty on people who choose not to insure, and in that way provides an incentive for lower premiums. True, the act permits different premiums for different age groups. But that is defensible, and is in any case better protection against gouging than allowing insurers to ?cherry-pick? within each age group by demanding exorbitant premiums from those at greater risk.

She worries that if the Supreme Court does not strike down the act?s mandate, Congress will then force people to buy a raft of other commodities they do not want. I am naive, she says, in thinking that politics can prevent such corruption when government has proved so easily controlled by ?corporate interests.? I wish she had provided an example of what she has in mind. As I said, a statute forcing people to buy a particular industry?s product might well be unconstitutional for other reasons even if mandates are sometimes permitted. In any case, however, I continue to believe that the American public would be outraged by such coercion unless it was convinced that some emergency clearly required it. Angell fears that private companies have gained even more control over state legislatures than over Congress, but none of them, to my knowledge, has been able to secure a law forcing people to buy what they sell. When constitutional law does not stop them, politics does.

William Balfour Found Guilty in Jennifer Hudson Family Murder Case


William Balfour - the former brother-in-law of Jennifer Hudson who was arrested for killing her mother, brother and nephew - has been found guilty on three counts of first-degree murder.

Hudson (along with her fiancé and sister) was inside the courtroom when the verdict was read and sources tell E! News they sat silently throughout.

Balfour did not testify on his own behalf, although the Oscar winner did take the stand early on in the trial and broke down in tears at one point.

In addition to the murder charges, Balfour was found guilty of home invasion, residential burglary, aggravated kidnapping and possession of a stolen vehicle. He faces life in prison.

Matsunichi's MarquisPad MP977 tablet tempts us with $249, dual-core Android 4.0

You might remember Le Pan's tablets from CES this year, of which only one was truly ready at the time. The company is now ready to hit the US in earnest, but you'll have to forget the company name along with the earlier designs: it's now Matsunichi, and it's planning to kick off its US-ready makeover through the MarquisPad MP977. The tablet shares the 9.7-inch, 1024 x 768 display of the Le Pan II, but it's now running a slightly speedier dual-core, 1.2GHz TI chip (likely the same OMAP 4430 as in the Droid Xyboard), ships with Android 4.0 out of the gate and comes in a sleeker -- not to mention browner -- shell. Storage is being cut in half over the Le Pan II to just 4GB between the internal memory and a bundled microSD card, though, and the battery is good for a very modest five hours. Nonetheless, the $249 sticker and a May release will put the MP977 in the running with the slower but more capacious Galaxy Tab 2 7.0.

Matsunichi also teased us with a roadmap for a pair of future tablets in the process. The 10.1-inch MP1010 will keep the resolution, but it'll run on a quicker 1.5GHz TI processor and carry a total of 10GB of space when it appears sometime between June and August. If those 0.4 inches of extra glass are just too much to bear, an MP979 will bring all the extra storage and speed of the MP1010 to a 9.7-inch screen sometime between August and September.
